These Terms & Conditions govern your access to and use of Mavi’s websites, apps, and services. Please read them carefully. By using the Services you agree to be bound by them.
1.Acceptance of Terms
By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. We may update these Terms; continued use after changes means you accept the revised Terms.
2.Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services you represent that you meet these requirements and that the information you provide is accurate.
3.Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.
4.Nature of the Services
Mavi is a technology platform that connects you with independent, licensed U.S. healthcare providers and pharmacies. Mavi does not practice medicine, provide medical advice, or dispense medication. The provider-patient relationship is solely between you and the provider.
Content on the Services is for general information only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified provider with questions about a medical condition.
5.Consultations & Prescriptions
Any consultation, evaluation, prescription, or treatment decision is made at the sole discretion of the licensed provider. A prescription is not guaranteed and is issued only if a provider determines it is medically appropriate. Some products are compounded and may not be FDA-approved; these are provided pursuant to a valid prescription.
6.Orders, Pricing & Payment
Prices are shown before checkout and may change. You authorize us and our payment processor to charge your selected payment method for orders, applicable taxes, shipping, and any consultation fee. We may refuse or cancel orders, including for suspected fraud or errors.
7.One-time Purchases
Products are offered as one-time purchases. You authorize only the charge shown for the order submitted at checkout. Refunds are handled under the applicable refund policy and law.
8.Shipping & Returns
Shipping timelines are estimates. For safety and regulatory reasons, prescription and compounded products generally cannot be returned once shipped. Contact support for issues with a damaged or incorrect order.
9.Acceptable Use
You agree not to:
- provide false, misleading, or another person’s information;
- resell, divert, or misuse any medication or product;
- interfere with, disrupt, or attempt to gain unauthorized access to the Services; or
- use the Services for any unlawful purpose.
10.Intellectual Property
The Services, including content, trademarks, and software, are owned by Mavi or its licensors and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. All other rights are reserved.
11.Third-Party Services
The Services may link to or rely on third parties (such as payment, pharmacy, and telehealth partners). We are not responsible for third-party content or practices; your use of them is subject to their terms.
12.Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
13.Limitation of Liability
To the fullest extent permitted by law, Mavi and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid to us in the twelve months before the claim.
14.Indemnification
You agree to indemnify and hold harmless Mavi and its affiliates from claims, losses, and expenses arising out of your use of the Services or your violation of these Terms.
15.Termination
We may suspend or terminate your access at any time, including for violation of these Terms. Provisions that by their nature should survive termination will survive.
16.Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable law.
17.Changes to These Terms
We may modify these Terms from time to time. The “Last updated” date reflects the latest version. Material changes will be posted here and, where required, communicated to you.
